Area of application
These General Terms and Conditions of Sale apply to all orders placed through the website www.mas-conscience.com and for all orders received by mail or telephone, regardless of any other clauses that may appear on the buyer's documents. The customer acknowledges having read these General Terms and Conditions of Sale, the distance selling rules of the place where the company is based shall apply. The present contract is governed by French law.
Ordering
Domaine Mas Conscience commits itself to accept orders made by Internet under the terms of the present General Sales Conditions and within the limit of available stocks. In case of stock shortage, we will inform you of the supply time necessary to obtain the desired product or we will propose a replacement product. Domaine Mas Conscience will honour each order by making one or several deliveries of the ordered products. By validating the order, the customer declares that he/she has read and accepted the present General Sales Conditions. Domaine Mas Conscience reserves the right to cancel all orders, non-conforming or doubtful, as well as those from a customer with whom there is any dispute.
Validity of offers
The products are proposed within the limit of the duration of each sale and within the limit of available stocks. Domaine Mas Conscience cannot be held responsible for a possible stock shortage which would lead to a delay in the delivery of the order. Orders are only final when they have been confirmed by the payment of the price by the buyer. In case of unavailability of one or several products after the validation of the order, Domaine Mas Conscience will inform the customer by e-mail as soon as possible. In agreement with the customer, Domaine Mas Conscience may modify the order, or proceed to the reimbursement of the unavailable products.
Awards
The prices indicated are in Euros and include all taxes (applicable VAT, excise and all other applicable taxes). The price indicated in the order confirmation by Domaine Mas Conscience is the definitive price, expressed all taxes included and including VAT at 20% for France.
Delivery
Domaine Mas Conscience delivers everywhere in France. Packages are generally dispatched within 2 days after receipt of payment. Shipping fees include handling and packing fees as well as postage costs. Your package will be dispatched at your own risk, but special care is taken to protect fragile objects. Deliveries to other destinations will be subject to a specific quote. The delivery time for orders is 5 days for wines in stock and 8 to 15 days for other products, after receipt of payment. Non-working days include Saturdays, Sundays and public holidays. Any delays, except in cases of force majeure, may give rise to reimbursement at the customer's request. War, riot, fire, strikes, accidents and the impossibility of being supplied are considered as cases of force majeure discharging the seller from his obligation to deliver. The customer is obliged to carefully check his parcels upon delivery in order to immediately express any reservations to the carrier. The information given by the buyer when placing the order is binding on the buyer: in the event of an error in the wording of the recipient's details, the seller cannot be held responsible for the impossibility of delivering the product.
Payment
The payment of products purchased from Domaine Mas Conscience is payable in full at the time of order. The wines remain the property of Domaine Mas Conscience until the full payment of the invoices. Payments can be made by cheque, to the order of Domaine Mas Conscience, by credit card or by Paypal. An invoice will be established by Domaine Mas Conscience and sent to the customer at his billing address.
Ability to return
In application of the provisions of article L.121-16 of the Consumer Code, the buyer has a period of seven clear days from the delivery of his order to return the item delivered for exchange or reimbursement, at the buyer's choice, without penalty except for the return costs. The return costs are at the customer's charge. Domaine Mas Conscience commits itself to reimburse the customer, except for the return shipping costs which remain at his expense. The refund will be made within two weeks after receipt of the return. Returns are to be made to Domaine Mas Conscience, Route de Montpeyroux, 34150 St.Jean-de-Fos
Right of withdrawal
In application of the French Consumer Code, the buyer has a period of 7 days from delivery for wines to return the product and 7 days from the date of order for Primeurs, for exchange or reimbursement, without penalty, with the exception of return costs.
Reservation of ownership
In accordance with the law of 1er May 1980, the products delivered to the customer are sold under reservation of ownership. The transfer of ownership is subject to the total payment of the price of the products by the customer, on the due date agreed between the parties. In case of non-payment of the total price of the goods on the agreed due date, Domaine Mas Conscience may claim the ownership of the products at the customer's expense and risk.
Personal data
The creation of a customer account at Domaine Mas Conscience requires the customer to communicate a certain amount of personal data. This data is necessary for the processing of the order and the management of Domaine Mas Conscience's commercial relations with its customers and is kept confidential and is not used for commercial purposes by third parties. In accordance with the Law n° 78-17 of 6 January 1978 relating to data processing, files and freedoms, the consumer has the right to access and rectify any nominative information concerning him/her.
Guarantees
Domaine Mas Conscience is bound by the legal guarantee of hidden defects, in the sense of article 1641 and following of the Civil Code: "The seller is bound by the guarantee for hidden defects of the product which make it unfit for the purpose for which it was intended, or which reduce this use so much that the buyer would not have acquired it, or would have given a lower price, if he had known about them. Consequently, the customer has until 2 months after the delivery date to send his complaint to Domaine Mas Conscience. After this period, Domaine Mas Conscience will no longer be able to guarantee the wines and the customer will have to prove that the alteration of the wine is prior to the reception of the wine.
Protection of minors and public health
In accordance with article L.3342-1 of the Public Health Code, the sale of alcohol to minors under eighteen (18) years old is forbidden. Any customer of Domaine Mas Conscience commits to be at least 18 years old when placing an order at Domaine Mas Conscience. Alcohol abuse is dangerous for your health. Please consume and enjoy it in moderation.
Applicable law
The language of this contract is French. All the clauses of the present General Terms and Conditions of Sale, all transactions and purchase operations carried out from the website www.mas-conscience.com as well as by mail and telephone are governed by French law. Any dispute that cannot be settled amicably will be referred to the Courts of the head office of SAS Mas Conscience or to the Court of the department chosen by the customer.
